Marriage Law

1What for is the marriage law?

Sex paly a vital role in all living beings of the world. As for the creatures other than human beings, they will indulge in sex on seasonal basis and after that they willl live separately as per the law imposed by Allah on them. But since the mankind is allowed to function on his own, the guidance is necessary for him. Let us study how this marrital laws are proposed by Allah to mankind.

When a marrital relationship is formed between man and woman parental consent and social recognition are essential. No one in society can live a happy life in isolation; therefore, marriage is a union entered into with the blessings of parents from bride and bride groom . However, indulging in extravagant spending for this purpose is improper. (See 17:26-27)

Furthermore, to ensure marriages are entered into willingly, the Islamic social or administrative system must establish laws and guidelines. Without such arrangements—if people are simply allowed to cohabit based on individual whim—women in due course would eventually fall prey to men's lust and risk being reduced to mere commodities. This would destabilize the social order and deny women equal status in society. Thus, registering a lifelong contractual agreement—recognizing who is whose husband or wife—is essential. This is precisely what *Nikah* (Islamic marriage) is.

Readers might get certain doubts here. One might ask, "In Western nations and countries like the USA, there are no restrictions on sexual relationships, yet they seem to live well, don't they?" However, there is a crucial point to consider. Following World War II, Western nations and countries like Japan worked tirelessly—day and night—to recover from their losses and achieved significant economic growth within a few years. This prosperity has, so far, sustained their culture of hedonistic indulgence. Yet, this situation is unlikely to last long. Over time, their valor, virility, and foresight will inevitably decline. Moreover, they are leading only a mechanical life. Consequently, they will face problems from other directions, ultimately leading to their downfall. (See 26:199-208) Furthermore, future generations would suffer adverse effects regarding both physical health and intellectual capacity.

Therefore, the Quran also provides guidelines concerning marriage. Let us examine what these are here.

2Age for marriage

Verse 4:19 declares that it is forbidden to forcibly take a woman as a wife against her will. Furthermore, regarding guardianship of orphans' properties, the Quran specifies that these assets must be safeguarded until they reach the age of marriage (see 6:152). When discussing the parameters of marriage, the Quran speaks only of marrying adult women; it makes no mention of any child or minor’s marriage. Therefore, there is absolutely no place for child marriage in Islam. However, the Quran does not specify or fix a particular age for marriage. Thus, marriage should be arranged only when the individuals attain the capability to manage a family; alternatively, the government may also determine the age of marriage.

24:32. And marry off the unmarried among you and the capable among your male and female slaves. If they are poor, Allah will enrich them from His bounty; and Allah is All-Encompassing, All-Knowing.

Explanation

1. Certain guidelines must be considered when arranging marriages for those who do not have a spouse.

2. You should arrange marriages for the righteous (*Salihīn*) among you—whether men or women—who are capable of leading a family.

3. It does not matter if they are poor, widowed, or divorced.

4. In time, avenues will open for those with capability to receive Allah’s bounties.

5. Moreover, Allah’s plans are vast and grounded in wisdom.

6. It is essential that a man or woman not only reaches the age of adulthood for marriage but also possesses mental maturity and education, as these things concern their life. One might lack financial means initially but could receive Allah’s blessings over time; however, if they lack mental maturity, their entire life could be jeopardized.

24:33. Those who do not find the means to marry should maintain chastity until Allah enriches them out of His bounty.

Explanation

1. What should those who lack the means to marry do? They must exercise self-restraint until they become fully capable. Furthermore, they must uphold their moral integrity and avoid engaging in any illicit acts.

2. Marriage brings responsibility. Some mistakenly assume that once married, Allah will simply take care of everything. This is not a right concept. One should not arrange marriages for those who wander aimlessly without a sense of responsibility.

3. The reason is that one is advised to wait until Allah’s grace is attained; it also becomes evident that having sufficient earnings to support a family is essential.

3Prohibited relatives for marriage

4:22. Do not marry any of the women whom your fathers have married; indeed, this is an act of indecency, an abomination, and an evil path. But what has already passed is exempted from this ordinance.

Explanation

It is not proper for you to marry a woman whom your father has married, for she is [like] your mother. If such a marriage had already taken place before this revelations, there is no harm in maintaining that relationship. Hereafter no one should marry a woman whose father has already married her,

4:23. Apart from this, know which woman is forbidden to marry.

1. The mother who gave birth to you

2. Your daughters

3. Your sisters

4. Your father's sisters (paternal aunts)

5. Your mother's sisters (maternal aunts)

6. Your brother's daughters

7. Your sister's daughters

8. The nurse who breastfed you

9. Foster sisters (sisters through breastfeeding)

10. Your wife's mother; marriage with these women is prohibited.

11. Likewise, if you marry a woman and consummate the marriage, you must not marry the daughter she had with a previous husband—a daughter who is under your guardianship.

12. However, if you have not consummated the marriage with the woman you married, there is no harm in divorcing her and marrying the daughter she had with a previous husband.

13. You must not marry the wives of your own sons (daughters-in-law).

14. Furthermore, it is forbidden to have two sisters as wives at the same time.

15. However, if such marriages took place contrary to this rule during the pre-Islamic era of ignorance, let them remain; that is, do not seek to divorce them simply because this law has been enacted.

16. Indeed, Allah's laws and commandments offer protection and are full of mercy for people of all walks of life.

4:24 And also forbidden to you are married women, except those whom your right hands possess [captives of war]. This is the decree of Allah upon you. Lawful to you, beyond these, are all others—provided you seek them paying them your gifts, not in illicit sexual relations. So, for whatever enjoyment you derive from them, give them their due dowry (*Mahr*) as an obligation. And there is no blame upon you for what you mutually agree upon after the initial obligation; indeed, Allah is All-Knowing, All-Wise.

Explanation

1. Furthermore, you must not marry women who are already in a marital union with another husband.

2. If women who have embraced Islam come to you as refugees seeking safety and stay with you, you may marry them.

3. All these are the limits prescribed for you by Allah.

4. Apart from the women prohibited above, you may marry any other woman.

5. However, the marriage must be registered in accordance with the rules of marital law.

6. In this way, the couple should become life long partners who safeguard each other's well-being.

7. It is improper to enter into a marital relationship solely for the sake of sexual pleasure. The relationship must be based on the bond of husband and wife.

8. The prescribed 'Mahr' (dower)—a gift to facilitate the maintenance of life—must be given to the bride. This amount may be increased, decreased or fixed to be paid later with the mutual consent of both parties; there is no harm in doing so.

9. Know that all of Allah's laws and regulations are based on wisdom.

4Can anyone marry a woman against her will?

4:19. O you who believe! You must not forcibly take women as wives against their will. Furthermore, do not detain or mistreat them—with the aim of reclaiming what you have given to them—unless they have committed a flagrant act of immorality.

Explanation

1. One must not forcibly marry women who do not desire to marry you.

2. Additionally, one should not detain and mistreat his wife simply to reclaim the gifts or dowry previously given to her.

3. This implies that both the man and the woman should enter into marriage willingly and by mutual consent.

4. Therefore, if the prospective bride and groom see each other and find mutual compatibility, they may proceed with the marriage.

5. Furthermore, both parties must possess the mental maturity to understand the implications of marriage.

6. Consequently, there is no place in Islam for the marriage of minors.

5Is "love marriage" permissible?

Since the Quran permits a man and a woman to marry by mutual consent, some might assume that Islam sanctions romantic courtship (dating). This is a misconception. The reason is that young people in the throes of romance often lack the capacity to reflect objectively on various matters. They may treat love merely as a game or a time pass. The woman at her young age may not virtually have opportunity to understand her suitor's character or family background. Similarly the man at his young age may not have opportunity to understand the woman's conduct or family circumstances.

Therefore, parents should monitor their children's activities and ensure they do not fall into the trap of such romantic entanglements. If parents believe a relationship is unviable, they should explain this to their children and attempt to curb the relationship at its very inception. If this is allowed to grow unchecked, it becomes impossible to control the young lovers later on.

Such relationships are particularly likely to develop among college students or those who are employed. Therefore, parents must offer appropriate guidance and raise their children to be responsible individuals.

This is a matter that deeply affects the children's lives. We often see couples who—acting impulsively without any precaution—married under the emotional moment, only to find themselves mired in misery or pleading for divorce in court. Parents should caution their children about this from time to time. While there is nothing wrong with a man and a woman wishing to marry each other, it is not right to nurture romantic desires simply under the guise of being in love.

6Can a Muslim marry polytheists?

2:221. Do not marry women who associate partners with Allah until they believe; a believing slave woman is certainly better than a polytheistic woman, even if she attracts you. Likewise, do not marry [believing women] to men who associate partners with Allah until they believe; a believing slave man is better than a polytheistic man, even if he appeals to you. These [disbelievers] invite you towards the fire of Hell, whereas Allah, by His grace, invites you towards Paradise and forgiveness; He clearly explains His verses so that people may take heed.

Explanation

1. Certain principles must be observed regarding the bond of marriage.

2. Men who live with a sense of great ambition, guided by the Divine, should not marry women who live aimlessly, following their own whims.

3. However, marriage is permissible if she accepts the guidance (Iman) and strives to live accordingly.

4. For a virtuous, believing woman—even one of extreme poverty—is superior to her.

5. Similarly, believing women should not marry polytheistic men who live according to their own whims—regardless of how wealthy or attractive they may be.

6. A virtuous, believing man—even one of extreme poverty—is superior to such a man.

7. This is because it concerns your life; their actions lead only towards Hell.

8. Allah’s guidance, however, leads towards the secure life of Paradise.

9. Discern the correct path and follow it.

10. These regulatory laws are clarified so that all people may receive counsel.

Dear Intellectuals! Have you noted what the Quran talks regarding the compatibility between a bride and a groom? It emphasizes that neither wealth nor high social status is the priority; rather, good character is what matters. Thus, if a man finds a virtuous wife, it is akin to attaining Paradise; likewise, if a woman finds a virtuous husband, it becomes Paradise for her. This is precisely why we must raise children with good character!

7The ‘Mahr’ (Marriage Gift)

4:4. Give the women (whom you marry) their *Mahr* (marriage gift) willingly as a gift; but if they, of their own free will, give up any part of it to you, then consume it with pleasure and ease.

Explanation

You must provide the woman you marry with the *Mahr*—a gift to facilitate her marital life—commensurate with your means. This gift, the *Mahr*, should not be given with the intention of reclaiming it later, as it is meant to be an offering out of affection. However, if the woman willingly and voluntarily relinquishes a portion of it, there is no harm in you accepting it.

8Is Polygamy Permissible?

There is a common perception among people that Islam permits a man to marry up to four women—that is, one may have up to four wives. Such statements are made without knowledge of the facts. Please know what the truth actually is.

60:10. O you who believe! When believing women come to you as emigrants (having left their homes), examine them—Allah knows best their faith. If you find them to be believers, do not send them back to the disbelievers; for these women are not lawful for those men, nor are those men lawful for these women. However, repay the men what they had spent (on these women). Furthermore, there is no sin upon you if you marry them after giving them their due dowry (*Mahr*).

Explanation

1. O you who have accepted Divine guidance! Thoroughly examine whether the women who migrate from their hometowns have accepted Allah's guidance.

2. Integrate them into your community only after ascertaining details such as their identities, their places of origin, and their reasons for coming.

3. Allah knows the extent of devotion towards Islam present in their hearts.

4. Therefore, if you determine that they are true believers, do not send them back to the disbelievers.

5. The reason is that those men would mistreat or misuse these women; thus, it is not appropriate for these women to remain with such men.

6. Nor can they continue to live with them.

7. Furthermore, reimburse the men for expenses incurred, such as travel costs.

8. Additionally, if you wish to marry them, provide the necessary means for their livelihood and marry them. There is no sin in doing so.

9. During such times of war, permission is granted to marry more than one woman. "And if you fear that you will not deal justly with the orphans, then marry those that please you of [other] women, two or three or four..."

4:3. If you fear that a amicable resolution cannot be reached regarding orphan women, then marry the women who please you—two, three, or four.

Explanation

1. At times of war, if a situation arises where amicable arrangements cannot be made for the protection of destitute women (an emergency situation), the rule of monogamy (one man, one woman) is temporarily relaxed.

2. That is, during such times, the Islamic social or administrative system grants permission for men to marry up to four women—choosing those they prefer—to provide a livelihood and security for these vulnerable women.

3. Even in the absence of such a governing authority, an individual may make this decision to provide a life for destitute women.

4. These are the facts regarding the permission to marry four women. Furthermore, pay attention to what else is stated in that same verse.

4:3 But if you fear that you cannot act justly (among them), then (marry) only one woman, or content yourselves with those whom your right hands possess (a female captive/slave); this is the easiest way to avoid committing injustice.

Explanation

1. Those who fear they cannot treat their wives with absolute fairness and equality should limit themselves to a single wife. (See: 4:129)

2. Alternatively, they may marry the female attendants/captives they already possess.

3. This is the best approach to living securely while preventing injustice in society.

4. Bear in mind: Allah has emphatically stated that it is impossible to treat them absolute equally with love and affection and so it is advised to treat wives atleast equally in financial matters,. (See: 4:129)

5. However, the Guidance permits marrying more than one woman during times of war or civil commotions and chaos, primarily to ensure the protection of destitute women. But...

6. Marrying more than one woman under normal, peaceful circumstances is not appropriate.

7. Furthermore, prior to the revelation of the Quran, it was customary in Arabia to purchase female slaves for domestic service. The Quran put an end to this practice of female servitude by mandating that they be married and granted the status of a wife.

4:127. (O Reformist!) People ask you for guidance rulings concerning women; say to them, "Allah decrees for you regarding them..." What is recited to you in the Book concerns the orphan women—specifically regarding the *Mahr* (dowry) prescribed for them, which you desired to withhold while wishing to marry them—as well as the weak among children and the obligation to uphold justice for orphans. Indeed, whatever good you do for them, Allah is fully aware of it.

Explanation

1. O Leader of the community! They ask you for guidance rulings (*Fatwa*) regarding destitute women.

2. Tell them that Allah responds as follows.

3. We have already announced the legal guidelines to be observed regarding destitute women in verse 4:3 of this Book.

4. Accordingly, if you wish to marry them, you must give them the prescribed *Mahr* (gift/dowry).

5. You desire to marry them without giving any such gift; this is wrong.

6. Furthermore, continue to provide necessary assistance to children in a state of destitution and to the vulnerable.

7. Thus, for any good deed performed, the corresponding reward will certainly be received from Allah, for He is fully aware of everything you do.

8. In other words, every action you take will inevitably have its consequences.

9Extra Marrital or Pre-marrital Affairs

24:2 The adulteress and the adulterer—flog each of them with a hundred lashes. Do not let pity for them deter you from [enforcing] the law of Allah, if you truly believe in Allah and the Last Day; and let a group of believers witness their punishment.

Explanation

1. The Quran prohibits illicit sexual relations between a man and a woman.

2. If anyone violates this and engages in such a relationship without marriage, both parties become liable for punishment.

3. If such a relationship is proven (see 4:15 & 24:4), the Islamic court will order that each person be given one hundred lashes.

4. If you truly accept Allah’s guidance and the Hereafter—where there are ultimate consequences for human actions—then show no partiality to anyone when carrying out this punishment. (5) Furthermore, carry out this punishment in the presence of the general public so that it serves as a lesson to others.

24:3. An adulterer does not engage in an illicit relationship with any woman other than an adulteress or a polytheist; and an adulteress does not engage in an illicit relationship with anyone other than an adulterer or a polytheist—therefore, this is forbidden for the believers.

Explanation

1. The reason both parties must receive the punishment of one hundred lashes is that such an illicit relationship between a man and a woman can only occur with the mutual consent of both.

2. Neither the woman nor the man can be singled out as the sole offender in this matter.

3. If even one of the two were chast [in character], such an event would not be possible.

4. Such a relationship arises only if the man is of weak moral resolve or lacks any noble purpose in life.

5. Similarly, such an illicit relationship occurs only if the woman is also of weak moral resolve or lacks any noble purpose in life.

6. Therefore, both are liable for punishment. Furthermore, believers who accept and follow Divine guidance will abstain from engaging in such illicit acts.

10Points to be noted by nursing mothers

Many people are of the opinion that they shall have sexual intercourse as much as possible after the wife conceives. This is totally a misconception. The reason is... Wasting semen—considered a man's precious resource—leads to physical weakness and, over time, creates the potential for nervous debility. This can subsequently lead to conditions like diabetes and heart disease, ultimately shortening one's lifespan.

Furthermore, it is also said that a wife may abstain from sexual intercourse for forty days after childbirth; indeed, a widely held belief among Muslims is that resuming sexual relations after this forty-day period is ideal. There is also a belief that conception does not occur during the breastfeeding period. Such notions are prevalent in a society that places sole focus on sexual relations.

Additionally, some insist that a wife must comply whenever her husband initiates sexual intercourse, often using the threat of divine curse by angels to enforce this. Consequently, the wife is reduced to a mere machine for satisfying her husband's sexual appetite. Some men, driven by a habit of frequent sexual activity, may even seek out other women if their wife’s health declines. In some cases, continuous sexual activity after conception can lead to an intensified sexual desire in women.

Soon after delivery, emotions start to appear in women too. Because of this, many women's breast milk spoils. And for many, milk excretion is also blocked. Most lactating mothers experience engorgement. It is often fixed and then weaned. In this way the secretion of milk will soon stop. No one can deny that breast milk is the best food for a baby. But at the same time no one advises to lead a controlled married life. It is not possible for the couple to know all those facts. The couple should be convinced about these facts.

11Infectional diseases of children

One more important thing you must know. With a toddler by their side, many couples have sex unknowingly. The victims are not aware of the consequences of this. When a man's sperm and a woman's semen mix, the higher particles in the sperm become alive and mix with the air. Once ejaculated, the average number of cells it contains is sixty million. Think about it. If the germs in this mixed with women’s glands, mix with the air and go into the child's breath, diseases such as colds and diarrhea develop over time. Due to this, all the nutrients added to the child are wasted. These make the child very weak.

Then, they would say that the child is afflicted with dosha or impurity and perform some magical treatment. In recent times these have also gained clinical tolerance. Despite all these, the damage caused to the child is damage. It cannot be fixed. Even when corrected with medical facilities, some children experience stunted cognitive development. Some of them experience irritability and lethargy. Some children are affected by diseases like polio and affect their physical development. This causes disease like polio.

12Proof for infectious diseases? (Infectious Diseases)

Don't take the above for granted. Think deeply and do research on it and only then accept it. We bring to your attention some cases to prove that all this is true.

If the child is vaccinated against measles, only then will the husband and wife be told to remain abstinent. Why? This is because the germs formed in the mixture attack the measles and cause irritation. What does this tell us? Mixed germs are spread through the air during intercourse.

That is why most children growing up in homes are weaker than children growing up on the streets. The reason is that the mixed germs mix in the atmospheric air there. It doesn't hit the baby that much. When it gathers in the rooms of the house, the mixed germs spread inside the room and cause the child to suffer from colds and diarrhea.

Keeping this concept in mind, couples who want to have sex should find a safer way to avoid harming the baby. You can give the child to the adults and gather. Also touch the baby only after a good bath. The baby should be nursed only after it is clean. And it should be gathered only after making arrangements for bathing.

13A man's virility is a treasure!

Dear intellectuals! A disease-free life is considered to be unlimited wealth. We just have to learn how to live without disease and pains. That is why both husband and wife should get used to living with control in married life. Avoid watching erotic scenes or listening to erotic stories.

It is wisely said that too much of anything is good for nothing. Similarly, uncontrolled sex affects the physical condition of most people. Not even forty years old. By then, they die from diseases such as diabetes, blood pressure, cholesterol, and arthritis. Sperm in men is a priceless treasure. Keeping it as safe as possible is the only way to maintain health. This is the secret of success in family life.

Apart from that, it is also very important to protect women from the effects of excessive vaginal discharge. Educated medical experts do advise on this repeatedly. Approach them and get advice.

So, if you want to live long and disease-free, keep in mind what we have said and get used to living with control. The Quran compares the sexual intercourse between husband and wife to agriculture and leaves us in awe.

14How other animals are involved in orgasm?

Take other animals and bird species. All of them engage in orgasm at a fixed time. After that, the female race does not allow the male race to approach. Look out for even a dog wandering the street. It goes away after conception, but the situation is different for humans. They engage in sexual intercourse as much as possible to satisfy their carnal desires, which adversely affects their physical health. While other living beings in the world do not contract new types of diseases, humans alone are afflicted by all manner of novel diseases due to their harmful habits.

All are engaged in finding cures for those diseases, but no one comes forward to identify the root cause of the diseases and fix them.

2:223. Your wives are like your fields. Get home whenever you want.

A farmer does not sow seeds in the ground every day. But men are engaged in sex time and time again and he is sowing the seed called sperm in the woman's womb because of lust. He does not know the facts about the repurcussions that would follow in due course.

15Cinema, Television and Communication (Internet)

Know one more thing. When any an appropriate activity starts to take place in society, there is opposition to it in the initial stage. But with time it becomes a habit and they become better known. Take cinema for example. In the early stages the love scenes were very realistic. A boyfriend was never even allowed to touch his girlfriend. But in course of time they gradually grew and allowed the lover to touch the beloved. It has grown and crossed the line in today's era. There is no control over anything.

Parents cannot watch movies with their children. It got that bad. But they are very interesting for young people. This gradually stirs up the dormant passions of the youth. Not to mention the television and communication devices that make up the home in today's modern age. The quality has deteriorated to such an extent. As a result, lustful emotions grow wild and unbridled, and the youth wanders in search of a way to go astray. Thus some people are forced into the habit of interacting with many people.

And some youths also fall into bad habits like self-indulgence or homosexuality. Due to this, little by little, the reproductive organs of women and the sperm of men start to be affected. When such weak people have sex, weak children are born. Those children who grow up and marry and have children born to them are more likely to be weak, premature or malformed. This means that the mistakes made by this generation will affect the next generation. Finally, the next generation will cry out “What a sin we have committed?” They will be lamenting why such miseries befall us. So they blame the Rabbu and complain that Rabbu is testing us like this.

If this situation is not to happen, let us all have a controlled married life. And let's take appropriate measures to reduce obscenity in the society!
