بِسۡمِ ٱللَّهِ ٱلرَّحۡمَٰنِ ٱلرَّحِيمِ
Whatever program we initiate in our life, will be as per the Pre-Directed Guidelines of Allah, the Most Benevolent and the Most Merciful. (6:162)
يَٰٓأَيُّهَا ٱلنَّبِيُّ إِذَا طَلَّقۡتُمُ ٱلنِّسَآءَ فَطَلِّقُوهُنَّ لِعِدَّتِهِنَّ وَأَحۡصُواْ ٱلۡعِدَّةَۖ وَٱتَّقُواْ ٱللَّهَ رَبَّكُمۡۖ
65:1. O Reformism! On admitting the divorce petition in the court or Jama’ath, inquire into the account of the woman's menstruation and give the couple three mensuration periods notice accordingly. (See: 2:228-237 & 33:49)) Obey this command of Allah.
لَا تُخۡرِجُوهُنَّ مِنۢ بُيُوتِهِنَّ وَلَا يَخۡرُجۡنَ إِلَّآ أَن يَأۡتِينَ بِفَٰحِشَةٖ مُّبَيِّنَةٖۚ وَتِلۡكَ حُدُودُ ٱللَّهِۚ وَمَن يَتَعَدَّ حُدُودَ ٱللَّهِ فَقَدۡ ظَلَمَ نَفۡسَهُۥۚ لَا تَدۡرِي لَعَلَّ ٱللَّهَ يُحۡدِثُ بَعۡدَ ذَٰلِكَ أَمۡرٗا١
If the divorce petition is on the grounds of her indecent act, she could be evicted from the house. If the petition is applied for other reasons, the couple is allowed to stay in the same house until the disposal of the verdict. (See 65: 4) These are the limits set by Allah. Whoever transgresses this becomes the greatest wrongdoer. Because with this, the couple will get the chance to live together again, right? It is with this in mind that such procedures are announced.
If the divorce petition is filed by a woman due to her husband's harassment, she need not stay at her husband's house.
فَإِذَا بَلَغۡنَ أَجَلَهُنَّ فَأَمۡسِكُوهُنَّ بِمَعۡرُوفٍ أَوۡ فَارِقُوهُنَّ بِمَعۡرُوفٖ وَأَشۡهِدُواْ ذَوَيۡ عَدۡلٖ مِّنكُمۡ وَأَقِيمُواْ ٱلشَّهَٰدَةَ لِلَّهِۚ
65:2. At the end of the term, review if there is any way for the couple to live together again. The couple can withdraw the talaq petition if they wish, retains the marital status or they can separate legally. Two witnesses from arbitrators have to be attested even if they want to cancel the thalaq petition, live together again, or separate. This should be recorded and the signature of those witnesses should be attested according to the law of Allah.
ذَٰلِكُمۡ يُوعَظُ بِهِۦ مَن كَانَ يُؤۡمِنُ بِٱللَّهِ وَٱلۡيَوۡمِ ٱلۡأٓخِرِۚ وَمَن يَتَّقِ ٱللَّهَ يَجۡعَل لَّهُۥ مَخۡرَجٗا٢
This advice is given to those who work in obedience to Allah and the law of “The ultimate result of human deeds.” So, any society that follows the guidance of Allah will get the ways to establish a better society.
وَيَرۡزُقۡهُ مِنۡ حَيۡثُ لَا يَحۡتَسِبُۚ وَمَن يَتَوَكَّلۡ عَلَى ٱللَّهِ فَهُوَ حَسۡبُهُۥٓۚ إِنَّ ٱللَّهَ بَٰلِغُ أَمۡرِهِۦۚ قَدۡ جَعَلَ ٱللَّهُ لِكُلِّ شَيۡءٖ قَدۡرٗا٣
65:3. In that society, the facilities of livelihood will increase to such an extent that they could not have imagined. And any society that acts with complete faith in the guidance of Allah is such a society. Surely this promise of Allah will be fulfilled. This is because Allah has set legal limits for each case.
وَٱلَّٰٓـِٔي يَئِسۡنَ مِنَ ٱلۡمَحِيضِ مِن نِّسَآئِكُمۡ إِنِ ٱرۡتَبۡتُمۡ فَعِدَّتُهُنَّ ثَلَٰثَةُ أَشۡهُرٖ وَٱلَّٰٓـِٔي لَمۡ يَحِضۡنَۚ وَأُوْلَٰتُ ٱلۡأَحۡمَالِ أَجَلُهُنَّ أَن يَضَعۡنَ حَمۡلَهُنَّۚ وَمَن يَتَّقِ ٱللَّهَ يَجۡعَل لَّهُۥ مِنۡ أَمۡرِهِۦ يُسۡرٗا٤
65:4. Also, some women may not have menstruation due to old age or due to health conditions. In the case of such women, the period given after admission of thalaq petitions by the court or Jama’ath is three months. (See 2: 228) If the woman becomes pregnant during this interval, that period will be extended until her delivery of the child. These are just some of the procedures which will help you to avoid divorce. So whatever community adheres to the limits of Allah, then everything will be in order.
ذَٰلِكَ أَمۡرُ ٱللَّهِ أَنزَلَهُۥٓ إِلَيۡكُمۡۚ وَمَن يَتَّقِ ٱللَّهَ يُكَفِّرۡ عَنۡهُ سَئَِّاتِهِۦ وَيُعۡظِمۡ لَهُۥٓ أَجۡرًا٥
65:5. These are the commandments about thalaq. They are blessed to know these things well and to act accordingly. Any society that follows the guidance of Allah will get rid of the bad habits that were prevalent in them and it will become a great dignified society.
أَسۡكِنُوهُنَّ مِنۡ حَيۡثُ سَكَنتُم مِّن وُجۡدِكُمۡ وَلَا تُضَآرُّوهُنَّ لِتُضَيِّقُواْ عَلَيۡهِنَّۚ وَإِن كُنَّ أُوْلَٰتِ حَمۡلٖ فَأَنفِقُواْ عَلَيۡهِنَّ حَتَّىٰ يَضَعۡنَ حَمۡلَهُنَّۚ
65:6. In accordance with the pledge you have taken, do not prohibit her from staying in your home as long as you get the Decree of Divorce. And help her at your convenience. Do not harass her in any way. If she conceives, make arrangements for her until she gives birth.
فَإِنۡ أَرۡضَعۡنَ لَكُمۡ فََٔاتُوهُنَّ أُجُورَهُنَّ وَأۡتَمِرُواْ بَيۡنَكُم بِمَعۡرُوفٖۖ وَإِن تَعَاسَرۡتُمۡ فَسَتُرۡضِعُ لَهُۥٓ أُخۡرَىٰ٦
If she wants to breastfeed after the baby is born, make the necessary arrangements for her until then. Consult with each other about this and make a decision. (Also, Ps 2: 233) If there is a problem with breastfeeding, the baby can be breastfed by another nursing mother.
لِيُنفِقۡ ذُو سَعَةٖ مِّن سَعَتِهِۦۖ وَمَن قُدِرَ عَلَيۡهِ رِزۡقُهُۥ فَلۡيُنفِقۡ مِمَّآ ءَاتَىٰهُ ٱللَّهُۚ لَا يُكَلِّفُ ٱللَّهُ نَفۡسًا إِلَّا مَآ ءَاتَىٰهَاۚ سَيَجۡعَلُ ٱللَّهُ بَعۡدَ عُسۡرٖ يُسۡرٗا٧
65:7. So let the affluent help her according to his convenience. Those who are in dire straits without access to facilities can apply to Allah’s rule to accept the cost of her maintenance. The purpose of the law of Allah is that no one should be harmed in a way that is beyond one’s capacity. When bringing about such social reforms, difficulties may arise at an early stage. But as time goes on all these problems will be removed and all the advantages will occur.
وَكَأَيِّن مِّن قَرۡيَةٍ عَتَتۡ عَنۡ أَمۡرِ رَبِّهَا وَرُسُلِهِۦ فَحَاسَبۡنَٰهَا حِسَابٗا شَدِيدٗا وَعَذَّبۡنَٰهَا عَذَابٗا نُّكۡرٗا٨
65:8. O followers of Our Guidance! Many societies that have previously refused to accept such advice of Allah and the constitutional by-laws and acted as a substitute for them have perished. The reason was that so many problems arose in society. They were subjected to deadly torments that they could not solve.
فَذَاقَتۡ وَبَالَ أَمۡرِهَا وَكَانَ عَٰقِبَةُ أَمۡرِهَا خُسۡرًا٩
65:9. So they suffered retribution for what they used to do. They acted in defiance of the instructions of Allah and received no benefit. Instead, they were at a great loss.
أَعَدَّ ٱللَّهُ لَهُمۡ عَذَابٗا شَدِيدٗاۖ فَٱتَّقُواْ ٱللَّهَ يَٰٓأُوْلِي ٱلۡأَلۡبَٰبِ ٱلَّذِينَ ءَامَنُواْۚ قَدۡ أَنزَلَ ٱللَّهُ إِلَيۡكُمۡ ذِكۡرٗا١٠
65:10. In the course of time, many problems will arise and take the form of torments when they deviated from the advice of Allah. Allah has made such laws of consequences.
So, those who have the wisdom to accept the guidance of Allah! Fear the calamity that will befall you, if you deviate from the guidance of Allah. Know that the laws that you can follow at all times have been bestowed by Allah and act accordingly.
رَّسُولٗا يَتۡلُواْ عَلَيۡكُمۡ ءَايَٰتِ ٱللَّهِ مُبَيِّنَٰتٖ لِّيُخۡرِجَ ٱلَّذِينَ ءَامَنُواْ وَعَمِلُواْ ٱلصَّٰلِحَٰتِ مِنَ ٱلظُّلُمَٰتِ إِلَى ٱلنُّورِۚ
65:11. There is a reformist among you who clearly articulates the guidance of Allah. Now you have the Qur’an that he handed over to the people. So, any society that knows their true status, accepts them, and works accordingly to devise creative social welfare schemes will be freed from the darkness of ignorance and come to the light of being wise.
وَمَن يُؤۡمِنۢ بِٱللَّهِ وَيَعۡمَلۡ صَٰلِحٗا يُدۡخِلۡهُ جَنَّٰتٖ تَجۡرِي مِن تَحۡتِهَا ٱلۡأَنۡهَٰرُ خَٰلِدِينَ فِيهَآ أَبَدٗاۖ قَدۡ أَحۡسَنَ ٱللَّهُ لَهُۥ رِزۡقًا١١
Thus, the society of those who accept the guidance of Allah and devise creative social welfare schemes will become like Paradise. And the economic facilities there will grow like a life-giving perennial river. In which they will remain in a permanent paradise until they perform better. For such communities, ways are open to living beautifully according to the canon of Allah.
ٱللَّهُ ٱلَّذِي خَلَقَ سَبۡعَ سَمَٰوَٰتٖ وَمِنَ ٱلۡأَرۡضِ مِثۡلَهُنَّۖ يَتَنَزَّلُ ٱلۡأَمۡرُ بَيۡنَهُنَّ لِتَعۡلَمُوٓاْ أَنَّ ٱللَّهَ عَلَىٰ كُلِّ شَيۡءٖ قَدِيرٞ وَأَنَّ ٱللَّهَ قَدۡ أَحَاطَ بِكُلِّ شَيۡءٍ عِلۡمَۢا١٢
65:12. If you have any doubt about the promise of Allah, then examine the works of the universe. You know how infinite the power of Allah is in the creation of the seven skies and the earth and other worlds like them. Thus, you should know that all the creations in the universe work under command from Allah, the Almighty. He created the legal rules for each of His creations. So, you will get special status by living accordingly
Dear Intellectuals! All legal provisions in the matter of thalaq have been bestowed by Allah. Yet the talaq laws in force among Muslims are different. That is why the status of Muslims is deteriorating. Let's explore this and act in the light of the Quran!
Chapter No: 66 – Soorah: Thahreem (Prohibition)
